Terms and conditions
 1. Where these terms and conditions use terms such as "we", "us" and "our" they refer to our company.
 2. These general terms and conditions apply to all offers from company and  are accessible to everyone and can be found on company
 3. We offer this website, including all the information, tools and services available on it, on the condition that you accept these terms and conditions and the associated privacy policy available on our website.
 4. By placing an order you indicate that you agree with the delivery and payment conditions.
 5. The company respects your privacy. We use your information for processing your order and will not give or sell it to another party, except the forwarder company  might send you a newletter via e-mail. Every e-mail will contain a unsubscribe link.
 6. The company guarantees that the delivered product complies with the agreement and meets the specifications stated in the offer.
  
GENERAL CONDITIONS
 7. We reserve the right to refuse service to anyone, for any reason, at any time.
 8. Any content that you enter onto this website may be transferred unencrypted and involve transmissions over various networks and may involve changes in order to conform and adapt to the technical requirements of connecting networks or devices.
 9. You may not reproduce, duplicate, copy, sell, resell or otherwise exploit for commercial gain, or otherwise, any portion of any of the content on the website or any other part of the service that we offer on this website.
  
ONLINE STORE TERMS
 10. We will take all reasonable care to ensure that the details displayed for a particular item offered for sale are correct at the time when the information was entered onto the system.
 11. Whilst care is taken to ensure that we display as accurately as possible appearances, colours, textures or finishes, what you will see on your computer monitor or equipment may differ and so we cannot guarantee that images are an accurate representation of the actual goods that you are purchasing. All batteries chargers and accessories are however genuine. We source stock directly from the manufacturer, or first line distributor. Authenticity is guaranteed.
 12. We may not be able to accept your order due to one or more of the following reasons, or for a reason not listed below:
 A) The item you have ordered is out of stock
 B) We cannot authorize your payment or  have reasonable grounds to suspect your payment may be fraudulent
 C) There has been a pricing or product description error
 D) There is a system or procurement failure
 E) You have failed our customer validation checks
 13. When you place an order you will receive an email confirming the details of your order.
 14. If an offer has a limited validity or has other specifications, this will be emphatically mentioned.
  
MODIFICATIONS TO OUR SERVICE AND PRICING
 15. All prices on the website are presented in EURO’s and include 20% VAT.
 16. Prices for items are subject to change without notice.
 17. We reserve the right to, at any time, modify or discontinue any part of the service that we offer, or any part of content thereof, without any notice to you.
 18. We accept no liability to you or to any third-party for any modification, price change, suspension or discontinuation of the service.
 19. We only accept payment that come directly from company or personal account of the buyer.  No payments coming from questionable sources or third parties will be accepted.
 20. The VAT number much always match the billing address of the company. If  the company insists on using a different billing address, the VAT number will be considered invalid.
 21. Unless otherwise agreed, the payment should take place within 7 days after the consumer has received the confirmation of the agreement.
 22.  The consumer has the duty to notify us about inaccuracies in the payment details.
 
DELIVERY
 23. Delivery takes place while stocks last.
 24. During checkout, you may be presented with one or more options for delivery. Please note that your items may be delayed in being received due to circumstances beyond our control (such as a courier delay, or at busy times).
 25. We shall observe in utmost care the reception and execution of orders of products.
 26. The address that has been made known by the consumer to us is considered to be the delivery place.
 27. We shall execute the accepted orders expeditiously but not later than within 30 days unless a longer period has been agreed. If the delivery is delayed or if a delivery cannot or partially be executed, the consumer is notified about this no later than 30 days after he placed the order. In that case the consumer has the right to terminate the agreement without any further cost and he is entitled to compensation.
 28. If the delivery of an ordered product appears to be impossible, we shall strive to make available a replacement product. At least before the delivery it will be mentioned in a clear and understandable manner that a replacement product will be delivered. The right of withdrawal cannot be ruled out with regard to replacement products. The costs of a possible return shipment come at our expense.
 29.  The risk of damage and/or loss of products rest with The company until the moment of delivery at the consumer, unless otherwise expressly agreed. If you receive a damaged product, you should report this by email within three days. You can send this email to: info at nkon.nl
 
 
ORDER CANCELLATION
 30. If you wish to cancel an order you have placed you  must contact us immediately to ascertain whether the items have been dispatched or not. Where they have been dispatched, you will need to return the item to us and you will be responsible for paying the cost of returning the items.
 31. Where items have not been dispatched prior to a cancellation request, our refund policy will apply.
 
RIGHT OF WITHDRAWAL
 32. After the purchase has been made, you have the possibility to change your mind and return the items without giving any reason within the period of 14 days.  This period starts after you have received the items.  Before proceeding with the return, the customer is obliged to notify The company  in writing within the period of 14 days after delivery. Return of the goods must be made in the original packaging (including accessories and accompanying documentation) and in new condition.
 33.  If you execute the right of withdrawal, you will have to pay no more than the costs of returning the product.  If you have made a payment, then we shall pay back this amount as soon as possible .
 34. Custom made products, such as batteries with tags and battery packs, are excluded from the right of withdrawal.
 35. The right of withdrawal will not be executed when;
 A) the customer has repaired and/or processed the delivered goods himself or has had them repaired and/or processed by third parties (Eg. battery pack).
 B) the delivered goods have been exposed to abnormal conditions or are otherwise handled carelessly or contrary to the instructions of NKON B.V. and/or instructions for use on the packaging have been treated.
  
WARRANTY
 36. The company guarantees the quality of products up to 24 months after delivery for mechanical parts and 12 months for electrical.
 37. The customer is obliged to check the delivered goods immediately upon receipt. If it appears that the delivered item is wrong, defective or incomplete, the customer must immediately report these defects in writing to The company  (before proceeding to return it to The company 1 months after delivery to The company to be reported in writing. The goods must be returned in the original packaging (including accessories and associated documentation) and in new condition. Putting into use after discovery of a defect, damage arising after discovery of a defect, encumbrance and/or resale after discovery of a defect, will invalidate this right to complain and return partially or completely.
 38. The warranty will not be executed when;
 A) the customer has repaired and/or processed the delivered goods himself or has had them repaired and/or processed by third parties (Eg. battery pack).
 B) the delivered goods have been exposed to abnormal conditions or are otherwise handled carelessly or contrary to the instructions of  The company and/or instructions for use on the packaging have been treated.
 
COMPLAINTS
 39. Complaints about the execution of the agreement must be described fully and clearly within reasonable time submitted to us after the consumer has observed the defects.
 40.  The complaints submitted to us will be answered within a period of 14 days from the day of receipt. If a complaint has a foreseeable longer processing time, we will answer within 14 days an acknowledgement and an indication when the consumer will receive a more detailed answer.
 41. If a complaint cannot be resolved by mutual agreement then there is a dispute that is subject to the dispute settlement.   Dutch law exclusively applies to agreements between entrepreneur and consumer whereupon these general conditions/terms are related to.
  
LIABILITY AND INDEMNITY
 42. We shall not be liable for any direct, special, indirect or consequential or incidental damages including loss of profit or loss of opportunity as a result of the use of or the inability to use any items that have been ordered on this website.
 43. You agree to indemnify us and our agents, officers, directors and employees, immediately and on demand, against all claims, liability, damages, costs and expenses, including legal fees, arising out of any breach of any of our terms and conditions.
